Terms of Service

These Terms of Service (“Terms”) govern your use of the Kuchenly mobile app and related services (“Kuchenly”, “the app”, “we”, “us”). By creating an account or using the app, you agree to these Terms. If you don’t agree, don’t use the app.

1. Eligibility

You must be at least 15 years old to use Kuchenly. If you’re under the age of majority where you live, you may only use the app with a parent or guardian’s involvement. By using Kuchenly you confirm you meet these requirements.

2. Your account

• You need an account (email/password or Google sign-in) to use most features.
• You’re responsible for keeping your login secure and for activity under your account.
• Provide accurate information and keep it current.
• Tell us promptly if you suspect unauthorised use of your account.

3. What Kuchenly does

Kuchenly helps you capture recipes (by voice, photo, or text), organise them, plan meals, and build shopping lists. Some features use artificial intelligence to interpret your input (see Section 5). The app depends on an internet connection and third-party services (see Section 8).

4. Your content

• You own your content. Recipes, photos, notes, plans, and lists you create or upload (“Your Content”) remain yours.
• You grant us a limited licence to store, process, and display Your Content only to operate the app for you (including sending it to our AI provider to interpret it — see Section 5 and the Privacy Policy). We don’t sell Your Content or use it for advertising.
• You’re responsible for Your Content and confirm you have the right to upload it. Don’t upload content that infringes others’ rights or breaks the law.

5. AI-generated content — important

• Kuchenly uses AI to turn your voice, photos, or text into structured recipes and to generate meal plans and shopping lists.
• Kuchenly does not provide medical, nutritional, dietary, or food-safety advice, and AI output is not a substitute for professional advice.
• Allergies & dietary needs: do not rely on the app to identify allergens or guarantee a recipe is safe for any diet or condition. Verify ingredients independently.
• You are responsible for safe food handling, cooking, and storage.

6. Acceptable use

Don’t:

• break the law, infringe others’ rights, or upload harmful or offensive content;
• attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to the app or its backend;
• abuse the AI features (e.g. automated/bulk requests, or use unrelated to personal recipe and meal planning);
• resell or commercially exploit the app without our written permission.

We may suspend or terminate accounts that breach these Terms.

7. Service availability & changes

• Kuchenly is provided on an ongoing best-effort basis; we may change, suspend, or discontinue features at any time.
• This is an evolving app — features may be added, changed, or removed.
• We may update these Terms; material changes will be notified in-app or by email, and continued use after changes means you accept them.

8. Third-party services

Kuchenly relies on third parties to function, including Supabase (authentication, database, hosting) and Google (Gemini) for AI processing. Your use is also subject to their terms, and their handling of data is described in our Privacy Policy. We’re not responsible for third-party services we don’t control.

9. Termination

• You can stop using Kuchenly and delete your account and all your data at any time from within the app (Settings → Delete account).
• We may suspend or terminate your access if you breach these Terms or to protect the app or other users.
• On termination, your right to use the app ends; provisions that by nature should survive (e.g. Section 4 licence wind-down, Section 5, Section 10, Section 11) survive.

10. Disclaimers

To the extent permitted by law, Kuchenly is provided “as is” and “as available”, without warranties of any kind (including accuracy, fitness for a particular purpose, or uninterrupted/error-free operation). Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded.

11. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss, or for loss of data, profits, or goodwill, arising from your use of (or inability to use) Kuchenly. Where our liability cannot be excluded but can be limited, it is limited to (at our option) re-supplying the service or paying the cost of re-supply. Nothing here limits liability that cannot be limited by law.

12. Governing law

These Terms are governed by the laws of Australia (and the State/Territory of the operator’s principal place of business), and you submit to the non-exclusive jurisdiction of its courts, without affecting any mandatory consumer-protection rights in your country of residence.
